Phoenix Extreme DUI Lawyer

Protecting Your Against Serious Penalties

Driving under the influence is a serious criminal offense in the state of Arizona. DUI accidents account for a large majority of the serious or fatal car accidents that occur throughout the Phoenix metro area. When a person drives under the influence of drugs or alcohol, he or she has a much greater chance of causing an accident. When a driver's BAC reaches .15% or higher, then their chances of causing a serious or fatal accident double.

DUI Laws in Arizona

In the state of Arizona, a person will be charged with a DUI if his or her blood alcohol concentration (BAC) is .08% or higher. When BAC levels reach this percentage, the driver's level of alertness and coordination has become too impaired to safely operate a vehicle. An automobile can turn into a deadly weapon when it goes at high speeds and is not under the proper control.

When a driver's BAC reaches .15%, their ability to safely operate a vehicle becomes significantly more impaired, and a crash is almost inevitable. Even more serious than is DUI, Arizona has two other penalty categories known as extreme DUI and super extreme DUI.

Any person found with BAC of .15% or higher, that has operated a moving vehicle within the two hours prior to their arrest, will be charged with extreme DUI. According to the Arizona Revised Statutes 28-1382, extreme DUI is an incredibly serious class 1 misdemeanor offense that can result in a number of legal consequences.

Understanding Penalties

For a first time offense, the driver will spend 1-6 months in custody, $2,500 in fines, and they are required to have an ignition interlock device installed in their vehicle. This device will make it so the car will not start if they have a certain amount of alcohol in their system. Other penalties may include probation, jail fees, countless hours of community service, driver's license suspension or revocation, and more.

Even if it is the driver's first DUI offense, you may face enhanced legal penalties even if:

  • There was a minor in the vehicle
  • If the driver caused the accident
  • If they had any prior DUI/criminal convictions on their record
