Wrongful Death Lawsuit Filed for Young Girl's Death in Mission Viejo

A wrongful death lawsuit has been filed against Mission Viejo for the death of a young girl.

Last week Stephanie Bolton filed the lawsuit on behalf of 17-year-old Anastasia Bolton who was killed by a Metrolink train last September after falling asleep on the tracks. The claim states that there was "no fencing or other warning existed in the area where Anastasia accessed the tracks." She is hoping to claim "premises liability" and blames the city for failing to provide warning of an area that had high traffic and inherent danger. Stephanie, whose relationship to the victim was not mentioned in the lawsuit, is asking for $5 million in damages as well as an unknown amount of future costs based on the "wrongful death, costs, life expectancy."

In addition to Bolton's loss another young man was killed, 22-year-old Daniel Akins of Mission Viejo, while Silvia Lua, 27, was injured.
