Arizona Robbery Laws

According to Arizona law, a person commits robbery if:

"in the course of taking any property of another from his person or immediate presence and against his will, such person threatens or uses force against any person with intent either to coerce surrender of property or to prevent resistance to such person taking or retaining property."

If you have been charged with robbery, you need to speak with an experienced Phoenix robbery attorney who is familiar with handling robbery charges. Unfortunately, prosecutors will often overzealously punish an individual who allegedly stole an item by charging that person with robbery when it is unwarranted.

At Knowles Law Firm, PLC, your attorney will investigate every aspect of your case in order to give you the best possible defense. Robbery can be charged as a class 4 felony in Arizona, which can result in up to 2.5 years in prison if this is your first criminal offense.

Types of Robbery Charges in Arizona

Under ARS 13-1902, Arizona classifies robbery into three categories.

  • Basic Robbery - Taking another person's property by force or threat of force. This is a felony and the penalties can include up to 3.75 years in prison even for a first-time offense.
  • Aggravated Robbery - Robbery that is committed by multiple individuals. Aggravated robbery is also a felony and can include up to 8.75 years in prison for a first offense. Repeat offenders can face up to 16 years in prison.
  • Armed Robbery - As the most serious robbery offenses, armed robbery involves the use of a deadly weapon or threatening to use a deadly weapon. Penalties can include between 7 to 21 years in prison for a first offense.

The penalties you face will vary depending on the circumstances of the crime. Talk to an experienced attorney to help you better understand the nature of your charges and potential defenses.
